Fee arbitration programs

Two proposed amendments to the guidelines and standards for mandatory fee arbitration programs would eliminate some language and add a statement prohibiting a party’s waiver of the right to non-binding fee arbitration as a condition to entitlement to a three-member panel.

Notice of rights after fee arb

Proposed revision to the Notice of Your Rights After Fee Arbitration Form would include a new informational section confirming a party’s right to request the arbitrator(s) to correct or amend an arbitration award, if made timely after service of the award, in addition to the right to petition the court for such relief.

Professional conduct rules

Sixty-nine proposed new and amended Rules of Professional Conduct are the sixth group of proposed rules developed by the State Bar’s Special Commission for the Revision of the Rules of Professional Conduct. Among other things, the rules cover Duties to Prospective Client, Voluntary Pro Bono Publico Service, Purchase and Sale of a Law Practice and Disclosure of Professional Liability Insurance.
